By scheduling a pickup or otherwise engaging with MyFairFlip, you agree to these Terms of Service in full. If you do not agree with any part of these terms, please do not use our services. MyFairFlip reserves the right to update these terms at any time, and continued use of our services constitutes acceptance of any changes.
MyFairFlip provides resale services whereby we collect items from clients, list them for sale on third-party platforms such as eBay, and remit 50% of the final sale price net of eBay's Final Value Fee to the client after the item has shipped. We make no guarantee that any item will sell, nor do we guarantee a specific sale price or timeline. All listings are created at our sole discretion.
By submitting items to MyFairFlip, you confirm that you are the lawful owner of all items provided, or have explicit authorization from the owner to sell them. You agree that MyFairFlip bears no responsibility for items submitted without proper ownership or authorization. You will indemnify and hold MyFairFlip harmless from any claims arising from disputed ownership.
MyFairFlip is not liable for any loss, damage, or theft of items while in our possession beyond commercially reasonable care. In the event of accidental damage or loss, our liability is limited to the estimated fair market value of the item at the time it was received, not to exceed the anticipated sale price. We are not responsible for losses due to market fluctuations, buyer disputes, platform policy changes, or shipping carrier errors once an item has been handed to the carrier.
Items that do not sell within a reasonable listing period may be returned to the client at no charge, donated to a local charity, or disposed of responsibly — at the client's direction. If no direction is provided within 14 days of notification, MyFairFlip reserves the right to donate or responsibly dispose of the item. MyFairFlip is not liable for items once they have been donated or disposed of following this notice period.
Clients will receive 50% of the final sale price net of eBay's Final Value Fee, paid within 7 business days of the item's confirmed ship date. Payment will be issued via the method agreed upon at the time of pickup (check, Venmo, PayPal, or Zelle). MyFairFlip is not responsible for delays caused by third-party payment processors. In the event of a buyer return or chargeback, the client's payout may be adjusted or recovered accordingly.
Clients may not submit items that are illegal to sell, counterfeit, hazardous, stolen, or otherwise prohibited by eBay's policies or applicable law. MyFairFlip reserves the right to refuse or return any item at its sole discretion. Submitting prohibited items may result in termination of service and, where applicable, reporting to relevant authorities.
These terms are governed by the laws of the State of California. Any disputes arising from or related to these terms or our services shall be resolved in the courts of San Diego County, California. If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
